Kenya Court Ends Criminal Prosecution of Teenagers in Consensual Sex Cases

Kenya’s High Court has issued a landmark ruling stopping the criminal prosecution of young people involved in consensual sexual relationships between teenagers, a decision widely described by rights groups as a major victory for adolescent rights and protection.

The ruling followed a petition filed by the Centre for Reproductive Rights on behalf of three Kenyan teenagers who were charged under defilement laws. In one case, a 17-year-old boy was arrested after police found him living with his 16-year-old partner and was charged under laws that criminalise sex with minors.

Under current Kenyan law, sexual activity involving persons aged 16 to 18 can attract penalties of up to 15 years in prison. However, the court ruled that authorities must now clearly distinguish between exploitative or abusive relationships and consensual relationships involving peers.

Judges also directed the government to strengthen access to sexual and reproductive health education and services, ensuring that young people can seek medical support without fear of arrest or stigma.

Human rights organisations say the previous legal approach discouraged many teenagers from accessing healthcare, contributing to increased risks of unintended pregnancies, sexually transmitted infections, and unsafe abortions.

The ruling is particularly significant in Kenya, where discussions around sex education and contraception remain highly sensitive due to cultural and religious influences.

Public health data estimates that nearly 800,000 abortions occurred in Kenya in the year leading up to May 2024, highlighting ongoing concerns about limited access to reproductive health services.

The decision is expected to reshape how law enforcement and courts handle adolescent relationships, while sparking broader national debate on youth protection, sexuality, and public health policy.
